What is the role of a divorce mediator?

A divorce mediator works as an impartial facilitator in the divorcing couple’s decision- making process.  Remaining neutral, the mediator does not legally advise or act as a lawyer on behalf of either spouse.  Spouses are given the opportunity to air their opinions and voice their requests in the presence of an unbiased third party.

More and more judges are seeing the value of mediation, which is why Georgia counties increasingly require mediation prior to allowing a divorce case to be tried.  Judges know that by permitting couples to make their own decisions, less enforcement is necessary than when the court determines a ruling.

When is divorce mediation not appropriate?

All divorces not being equal, there are situations where mediation is not suitable. An experienced Decatur divorce attorney will tell you that extreme domestic violence cases that involve spousal or child abuse or other criminal activity such as drug trafficking or habitual substance abuse usually do not lend well to mediation.  The violent or criminal party may threaten harm and is usually not willing to discuss issues.  In addition, domestic violence and drug related crime fall under Georgia criminal statutes, and a criminal case against the spouse may already be pending.
